Terms and Conditions for Birding Tours

1. General

Why Not Birds? offers private guided birding tours for individuals and small groups. In addition, open/public birding tours are occasionally arranged. By booking a tour, the customer accepts the terms and conditions below. The customer is the person making the booking and entering into the agreement with Why Not Birds? The customer is not necessarily a participant in the birding tour. These terms and conditions are drafted and shall be interpreted in Danish. Any translations are provided for guidance only. In the event of any discrepancy between the Danish version and a translated version, the Danish version shall prevail.

2. Booking and Payment

Booking takes place via e-mail: kontakt@whynotbirds.com. Birdwatching tours are planned in dialogue with the customer (e-mail correspondence is preferred), where we together agree on the overall content and framework of the tour. As a general rule, the date and locality/area are agreed upon at the time of booking, but in some cases the date, meeting time, locality, and other details may be agreed later. Once an agreement has been reached regarding the overall content and framework of the birdwatching tour, a booking confirmation will be sent including a summary of what has been agreed upon as well as payment information. A booking is only considered final once payment has been received. Unless otherwise agreed, the following payment deadlines apply:

  • As a general rule, payment must be made no later than 14 days after the booking confirmation, and always no later than 14 days before the tour date.
  • For bookings made less than 14 days before the tour date: payment as soon as possible and no later than 3 days before the tour date.
  • For bookings made less than 3 days before the tour date: payment at the time of booking (as soon as possible after receiving payment information and booking confirmation).
Failure to make payment will result in cancellation of the booking. The customer is responsible for providing correct contact information and informing us of any changes.

3. Price

All prices listed on the website are indicative. The final price is agreed upon at the time of booking and will appear in the confirmation. As a general rule, the price applies to up to 4 participants and remains the same whether there are 1, 2, 3, or 4 participants. The tours are private birding tours, and no participants other than the booking party will join the tour.

4. Cancellation – Private Tours

Cancellation by the Customer More than 14 days before the tour date: full refund. From 7 to 14 days before the tour date (inclusive): 50% refund. Less than 7 days before the tour date: no refund. For bookings made less than 14 days before the tour date: 3 days or more before the tour date: full refund. Less than 3 days before the tour date: no refund. It is possible to change the tour date by agreement and subject to availability. For special tours (e.g. involving external costs), different terms may apply. Cancellation by Why Not Birds? If Why Not Birds? cancels a birding tour before it takes place, the customer may choose between: a full refund of the amount paid, or rescheduling to a new date by agreement. If a birding tour must be shortened or cancelled during the tour due to weather conditions, access restrictions, temporary closures, or other circumstances beyond our control, any refund or rescheduling will be assessed on a case-by-case basis.

5. Public Tours

Participation in open/public birding tours takes place through the purchase of a ticket (e.g. via a ticketing system). Registration is binding, and purchased tickets are generally non-refundable. If a tour is cancelled by us, the ticket price will be refunded (excluding any fees, if applicable). If a tour is rescheduled to a new date, the ticket will be refunded if the participant is unable to attend.

6. No-show and Delays

No refunds will be given in the event of a no-show. In the event of delays, we reserve the right to shorten the tour, begin the tour without all participants, modify the planned itinerary, or cancel the tour if deemed necessary. Delays may, among other things, affect the planned course of the tour or other scheduled tours or commitments. In such cases, no refund will be provided.

7. Conduct of the Tour

Birding tours are planned in advance in dialogue with the customer, based on the type of tour, location, season, bird occurrences, participants’ wishes and interests, as well as level of experience. We aim, as far as possible, to accommodate wishes regarding content and experiences within the framework of the tour and what is considered practical and realistic on the day. On the day of the tour, adjustments may be made based on weather conditions, bird activity, and other factors if deemed likely to provide the best birding experience. Minor changes to the route, duration, or location may therefore occur. Any changes will always be kept within reasonable limits. Observation of specific species or numbers of birds cannot be guaranteed. We also reserve the right to unforeseen circumstances beyond our control.

8. Transportation

Transportation is not included in the tour price. Participants are responsible for their own transportation to and from the meeting point, as well as between the locations visited during the tour. Carpooling with the guide may, in some cases, be offered by prior agreement and takes place on a private, non-commercial basis. Carpooling is not part of the purchased service. Carpooling is typically possible for up to 3 participants. Pick-up from accommodation or a nearby train/metro station may, in some cases, be possible if practical and within a reasonable distance or along the route.

9. Participant Responsibility

Participation in birding tours is at the participant’s own risk. The tours take place in natural environments, where uneven terrain and changing weather conditions may occur. Participants are responsible for ensuring that they are able to complete the tour and for bringing suitable clothing and equipment. We expect participants to show consideration for nature, birds, and other people, and to follow the guide’s instructions during the tour. Birding tours are conducted with respect for birds, nature, and applicable access regulations.

10. Practical Information

Participants are encouraged to bring their own binoculars. In some cases, binoculars may be borrowed by prior arrangement. As a general rule, the guide will bring a spotting scope as well as a bird field guide/field reference (often digital), which may be used during the tour. Practical clothing and footwear appropriate to the season and weather conditions are recommended. As a general rule, participants are responsible for bringing their own food and drinks, unless otherwise stated for the specific tour or agreed in advance. Facilities such as toilets may be limited or unavailable at some locations.

11. Liability and Disclaimer

Why Not Birds? cannot be held responsible for circumstances beyond our control that affect the conduct of the tour, including weather conditions, traffic conditions, access restrictions, temporary closures, or other unforeseen events. We reserve the right for errors, omissions, and possible typographical errors in prices, descriptions, and other content on the website. We reserve the right to make necessary changes to plans, tours, and prices if circumstances require it, including changes related to partners or external costs.
